General conditions of purchase

SUBJECT

The following general conditions of sale regulate the contract for the purchase and sale of the products offered to customers through the website www.artigianato-italia.it by "L'Artigianato" owned by Ro.Ma. srl with headquarters in Piazza Navona no. 84, 00186 Rome, VAT no. 05775571002.

Sales procedures:

*Availability: 

The website displays the availability of each product in real time. In the event that the product is not currently available, the customer will still be able to purchase it and to view an estimated restocking date. This system allows the customer to know when the purchased item will be available again at "L'Artigianato", so they will only have to wait for delivery times. 

In the event that there is an error in the availability of the product, delays or impossibility in its replenishment, "L'Artigianato" will promptly notify the customer by email or by telephone to find a suitable solution to the problem.

*Order and Prices:

The customer will have the opportunity to view the products and their features which are provided directly by the producers of the goods themselves and/or by third parties specialised in the preparation of product datasheets. It is possible to view the published photographs for the sole purpose of illustrating the products by way of example. "L'Artigianato" sells numerous products that are almost entirely or partially handcrafted and must, therefore, be considered unique and different from each other.

For this reason, it is possible that there may be small differences in shape, colour and size compared to the photographs displayed on the website and the relevant product datasheet, as well as small imperfections, which testify to the purely manual production processes. In the case of significant differences found by "L'Artigianato", at its sole discretion, between the product ordered and the existing one, before making the delivery, "L'Artigianato" reserves the right to send a photograph to the customer to demonstrate the characteristics of the product being sent. 

The price displayed on the website is expressed in euros, including VAT, not including transport costs and any services requested. "L'Artigianato" reserves the right to change the price of products and/or services on the website at any time, at its sole discretion and without notice. The price on the product website is a price reserved exclusively for online purchases and, as such, must be managed exclusively on the web platform. In no case is it possible to take advantage of the same conditions of sale between the website and the shop, which are two distinct entities. In the event of a purchase by a non-EU customer, the VAT during the transaction will be separated. The customer who intends to purchase one or more products must follow the sales instructions on the website, and send their order to "L'Artigianato".

*Payments:

Payment can be made via the PayPal system or if requested by the customer by bank transfer.

PayPal: the PayPal system is a very efficient and secure credit card payment system. The PayPal system allows you to make payments by credit card without any obligation to register. For more information on the service, please visit www.paypal.it. "L'Artigianato", at no time during the purchase procedure is able to know the buyer's credit card details, which, through a protected connection, will be transmitted directly to the bank service provider. For this reason, "L'Artigianato" is not responsible for any fraudulent and/or illegal use that may be made by third parties of credit cards and other means of payment when paying for products purchased on its website.

Bank Transfer: upon request during the purchase procedure, "L'Artigianato" will send the necessary data to complete the transaction. For this form of payment, the order will be processed when the amount to be paid is actually credited, which can normally vary from 3 to 7 working days. The customer must send the receipt of the bank transfer via email to: info@artigianato-italia.it

*Order delivery:

"L'Artigianato" carries out shipments all over the world, relying on different express couriers, in order to offer the customer a better service by obtaining advantageous rates. Once the payment has been verified, "L'Artigianato" will prepare the order and, as soon as the goods are entrusted to the courier, will inform the customer of the shipment via email or telephone. 

Any duties and taxes applied by foreign countries are the sole responsibility of the customer.

"L'Artigianato" cannot be responsible for errors and/or failure to deliver the order due to inaccuracy or incompleteness of the form reserved for data relating to the shipment by the customer.

 "L'Artigianato" will not be responsible for delays in the collection, transport or delivery of any item regardless of the cause of the delay. "L'Artigianato", moreover, will not be responsible for loss, incorrect or failed delivery due to force majeure, fortuitous events and any other reason reasonably not attributable to "L'Artigianato". 

In no case can "L'Artigianato" be held responsible for direct and/or indirect damages and/or losses of any kind, however determined, that the Client may suffer regardless of whether or not "L'Artigianato" was aware that such damages could be caused. By way of example, but not limited to, indirect damages and losses are understood as: loss of profit, income, goodwill, customers, damage to image, etc. Without prejudice to the exclusion of responsibility of "L'Artigianato" for indirect damages, the customer has the right to take out a special insurance guarantee at their own expense to cover damages resulting from transport. It is understood that in the absence of insurance coverage, all the above-mentioned damages will be directly assumed by the customer on their own, given the above-mentioned exclusion is the responsibility of "L'Artigianato".

By way of derogation from articles 1686 and 1690 of the Italian Civil Code, if the transport cannot be carried out, "L'Artigianato" will inform the customer in order to find an appropriate solution to the problem. In the absence of timely instruction, "L'Artigianato" will keep the items in storage for 14 days without taking any responsibility for their maintenance.

The customer may also collect their purchase directly from the shop located in Piazza Navona No. 84, by appointment agreed by email, only on the days and during the opening hours of the shop. To collect the order, the customer must indicate the order number and a valid identity document. It is also possible to delegate a third person to pick up the order, but the customer must notify "L'Artigianato" in advance by email info@artigianato-italia.it indicating the personal details of the person delegated to pick it up. The delegate may collect the order only if provided with a written proxy signed by the customer and a valid identity document. 

*Customer Rights and Duties:

The customer is solely responsible for the truthfulness and correctness of the information and data provided to "L'Artigianato" for which it is forbidden to enter false and/or fictitious data during registration and ordering. The customer also undertakes to communicate any changes to the same.

The customer declares at the time of confirmation of purchase to have read, understood and accepted the General Conditions of Sale, and to authorise "L'Artigianato" to process personal data communicated at the time of purchase.

Upon delivery of their order, the customer must check:

- if the quantity of packages (boxes/parcels) indicated on the consignment note corresponds to that delivered

- that the packages (boxes/parcels) are intact, undamaged, unopened, not tampered with, not altered on delivery. If these anomalies are found, they must be immediately reported to the carrier and marked with their initials on the consignment note, under penalty of not obtaining future insurance cover and/or possible refunds.

Any complaints must be made via the following email address: info@artigianato-italia.it and will be processed within thirty days of their receipt at the latest. 

*Right of withdrawal:

The right of withdrawal, as per law, applies only and exclusively if the customer is qualified as a "consumer", i.e. as a natural person acting for purposes unrelated to business, commercial, craft or professional activity.

The customer can take advantage of the right of withdrawal without any penalty without specifying the reason, no later than fourteen days from the receipt of the purchased goods. 

To exercise the right of withdrawal, the customer must send a written notice by email to the following address info@artigianato-italia.it indicating the order identification number and specifying for which products he wants to exercise the right of withdrawal.

While exercising the right of withdrawal, the customer will have to bear the entire cost of returning the purchased products both if the product has already been delivered and if, as a result of the shipment already made, it will be delivered to the customer after the exercise of the withdrawal. 

The deadline for returning the product is fourteen days from the communication of the withdrawal. The customer must ship the product intact, undamaged, not tampered with, complete with original box, complete with any manuals and/or instruction booklets and include the order reference number inside the box. "L'Artigianato" will not accept returns that are damaged or with missing or incomplete packaging and in this case, no refund will be made and the goods received will be at the Client's disposal for a maximum of 10 days.

The items for which you wish to exercise your right of withdrawal must be returned to the following address:

For the customer who qualifies for the right of withdrawal, "L'Artigianato" will refund the amount paid by the customer with the exception of the direct cost of returning the product, which is always and in any case charged to the customer. The customer will be responsible for the decrease in the value of the product resulting from the incorrect use of the same.
